1.3. We may modify these Terms at any time by posting the revised version on our Site with a new “Last Updated” date. Your continued use of the Service after such posting constitutes your acceptance of the revised Terms.

1.4. Disclaimer: The Service leverages Artificial Intelligence (AI) for document generation. The outputs are templates only and may contain errors or omissions. You are fully responsible for verifying and customizing these documents with a qualified professional before using them. CompliWizard disclaims any liability arising from reliance on the AI-generated content.

  1. The Service

2.1. Service Overview: CompliWizard provides AI-generated document templates for compliance, health & safety, and related use cases. The AI uses information you provide in questionnaire fields, but we strongly advise you not to input personal or sensitive data.

2.2. No Personal Data: You agree not to submit any personal data (especially that of third parties) into free-text fields. If you choose to do so against our advice, you remain solely responsible for compliance with data protection laws.

2.3. Paid Subscriptions:

  • (a) Subscription Plans: We may offer different subscription levels or plans with varying features, limits, or term lengths. The details, fees, and renewal terms will be outlined at the point of purchase.
  • (b) Payment: You agree to pay all fees associated with your selected subscription. Payment is due in advance unless otherwise specified.
  • (c) Billing Cycles: Subscription fees will be billed at the start of each subscription cycle (e.g., monthly or annually) or as otherwise specified.

4.2. Liability Limitation: Under no circumstances will CompliWizard be liable for the outcomes, results, or consequences of using AI-generated documents. You assume all risk in using or implementing such documents.

5.1. Compliance with Policy: Your use of the Service must comply with our [Acceptable Use Policy](linked), which is incorporated by reference.

5.2. Prohibitions: You agree not to:

  • (a) Use the Service in any way that violates applicable laws or regulations.
  • (b) Enter personal, confidential, or proprietary information of third parties without authorization.
  • (c) Use the Service to create fraudulent, defamatory, or misleading materials.
  • (d) Attempt to disrupt or compromise the Service’s security or functionality.

Platform IP: All intellectual property rights in and to the Site, the Service, and associated software or content (excluding user-generated documents) remain the property of CompliWizard or its licensors. You receive a limited, revocable, non-transferable license to use the Service in accordance with these Terms.

6.2. User-Generated Documents: The documents generated by AI on your behalf are owned by you, subject to any underlying third-party rights or licenses. You remain responsible for ensuring that your use of these documents complies with all applicable laws and respects any third-party intellectual property rights.

7.1. No Warranties: The Service (including any AI-generated content) is provided on an “as-is” and “as-available” basis. To the fullest extent permitted by law, CompliWizard disclaims all warranties, express or implied, including accuracy, reliability, merchantability, or fitness for a particular purpose.

7.2. Safety & Compliance Disclaimer: While our Service is designed to help generate compliance-related documents, we are not certified compliance or safety advisers. The user must ensure final documents meet all relevant legal, regulatory, and safety standards.

  1. Limitation of Liability

8.1. Exclusion of Damages: To the maximum extent permitted by applicable law, CompliWizard and its officers, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of the Service.

8.2. Liability Cap: In no event shall CompliWizard’s total cumulative liability exceed the fees you have paid to CompliWizard in the twelve (12) months preceding the event giving rise to the claim (or €100, whichever is lower).

9.1. You agree to indemnify, defend, and hold harmless CompliWizard, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:

10.2. Jurisdiction: Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the Irish courts.

11.1. Termination by CompliWizard: We may suspend or terminate your access to the Service at any time, with or without cause, and without notice. Termination does not entitle you to any refund unless specified by law or a separate refund policy.

11.2. Termination by User: You may cancel your subscription or close your account at any time via your account settings or by contacting us.
